Terms of Service

Acceptance of Terms

By installing or using Felix Attribution ("Felix," "the App"), you agree to be bound by these Terms of Service ("Terms"). Felix is provided by H & Co Agency Inc. ("Company," "we," "us"). If you do not agree to these Terms, uninstall the App immediately.

Description of Service

Felix Attribution is a marketing attribution platform that tracks website visitors, matches them to purchases (online and in-store), and sends conversion events to advertising platforms (Meta Conversions API, Google Ads) on your behalf. The service includes a tracking script installed on your storefront, a dashboard for viewing analytics, and server-side integrations with ad platforms.

Billing and Subscription

Felix may offer a free trial period. After the trial period ends, subscription fees will automatically apply unless the App is uninstalled prior to trial expiration. Fees are charged through your e-commerce platform's billing system (e.g., Shopify invoices). All fees are non-refundable except as required by applicable law.

Your Obligations

As a user of Felix, you agree to:

• Provide accurate store and account information
• Comply with all applicable privacy laws and regulations, including GDPR, CCPA, and your jurisdiction's data protection requirements
• Maintain appropriate consent mechanisms for visitor tracking on your storefront (e.g., cookie consent banners)
• Comply with your e-commerce platform's acceptable use policies
• Not use Felix for any unlawful purpose or in violation of any third-party rights
• Maintain the security of your account credentials

Data Ownership

You retain full ownership of your store data, customer data, and purchase information. We do not claim ownership of any data processed through Felix. Our use of your data is limited to providing the attribution services described herein and in our Privacy Policy.

Ad Platform Integrations

Felix sends conversion data to third-party ad platforms (Meta, Google) on your behalf. You are responsible for maintaining valid ad platform accounts and complying with their terms of service. We are not liable for changes to ad platform APIs, policies, or data processing practices that may affect Felix's functionality.

Prohibited Activities

You may not:

• Reverse engineer, decompile, or disassemble any part of the App
• Share account credentials with unauthorized parties
• Use the App to conduct denial-of-service attacks or abuse the tracking infrastructure
• Attempt to access data belonging to other merchants
• Use the App in any manner that violates applicable law

Third-Party Services

Felix depends on third-party services including Shopify, WooCommerce, PlanetScale, Vercel, Meta, and Google. We are not liable for outages, data loss, or service disruptions caused by these providers.

Disclaimer of Warranties

Felix is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that attribution data will be 100% accurate.

Limitation of Liability

To the maximum extent permitted by law, H & Co Agency Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from or related to these Terms shall not exceed the fees you paid to us in the three (3) months preceding the claim.

Termination

Either party may terminate this agreement at any time. You may terminate by uninstalling the App. We may terminate or suspend your access if you violate these Terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes through the application or by email. Continued use of Felix after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
